    Introduction

    Times Changing in UK-IPO

    This autumn brings important changes to the UK-IPO, aligning the U.K. system ever more closely to that of OHIM.

    In particular, from 1 October 2007, the UK-IPO will no longer refuse trade mark applications on the basis of prior rights at the examination stage. The new system is outlined in detail in our “In the U.K. Office” section.

    Differences between the UK-IPO and OHIM remain, however, and sometimes they flag up inconsistencies that, if not addressed, may give rise to unequal treatment or legal uncertainty where rights are enforced. Arguably one such area is the gulf separating the practice of the two offices in construing specifications of goods and services, as highlighted in our “Alicante Abstracts” section. In this, a growing body of legal and academic opinion supports the more transparent practice of the UK-IPO and some of its sister offices in the E.U.

    As evidenced by the practice change following Kustom Amplifiers, also reported in “Alicante Abstracts,” OHIM has shown an admirable willingness to change where appropriate. One might hope that OHIM will apply the same critical eye to an objective review of its specification practice, for the ultimate benefit of CTM users.
