• Introduction

This edition of Make Your Mark once again reflects a broad range of topics of interest to trade mark owners and practicioners. In particular, we report on recent cases that have dealt with the following difficult trade mark issues: What does identity mean when considering trade mark registration and infringement, what type of use infringes a registered trade mark or saves a trade mark registration from revocation and what types of action constitute bad faith? In spite of the decisions reported here, some of the above questions have still to be definitively answered. As usual, Make Your Mark offers its own opinions. Even if you disagree with them, we hope that you will find the views expressed stimulating.
